Representative Cases

This list is a partial list of the types of cases that I have settled or tried to jury verdict.  It is meant to illustrate the types of cases that John has personally handled.  I have eliminated the names of the parties.

Aviation Litigation

  • Represented the Estate of a young woman killed in a small plane that crashed into a mountain in Colorado after the plane flew into a snowstorm. The case settled without trial under a non-disclosure agreement.
  • Represented an individual who was injured when a crashing helicopter landed on them, pinning him under the wreckage. The case settled without trial for an undisclosed amount.
  • Represented the estate of a pilot killed by a mid-air collision at an air show.  The case settled without trial.
  • Represented the estate of a man killed in an air crash in Crooked Island, Bahamas.  The case settled without trial.
  • Represented a man who severely injured by a mid-air collision.  The case settled without trial.
  • Represented a man burned over 86% of his body after a crash that occurred during flight instruction.  The case settled without trial.
  • Represented the Defendant in an action brought against it by the plaintiff, who had lost a leg in a mid-air collision.  The case settled without trial.
  • Represented the Defendant FBO against claims against it for negligent entrustment of an aircraft after three people died in a plane crash.  The case was tried to a federal court jury which resulted in a defense verdict for my client.
  • Represented the defendant FBO (renter of the aircraft) in an action brought by the estates of three people who were passengers and died in a fiery crash.  The case settled without trial.
  • Represented the Defendant FBO, and it’s instructor when a student sued for severe personal injuries.  The case was settled.
  • The estate of a man killed in a plane crash sued the defendant owner of the aircraft.  The case settled.
  • Represented one of the defendants in a negligence action. The case was settled.
  • Represented the Defendant Flight Center in a claim brought against it. The case was settled.
  • Represented the plaintiff in a claim of a man injured against an airline and port authority.  The case settled.

Scuba Diving

  • 2.7 Million dollar assessment from a Hawaii Federal Court in damages after a three week trial against P.A.D.I and diver operators. A man from Canada died while on a diving excursion in Hawaii. He was accompanied on the dive by other family members. The Court determined that the dive leader, boat operator and deck hand were negligent in the manner in which they exposed divers to increased dangers posed by an underwater cavern and lava tube. He also found that the lack of provision of emergency onboard oxygen contributed the divers death. The award was reduced to 2.2 Million dollars as he also found the diver 20% negligent. A release signed by the divers prior to the dive was thrown out by the Court as against both maritime and Hawaiian law.
  • Represented the family of a diver who drowned during a scuba diving excursion in Florida.  Summary Judgment was sustained on appeal by a divided court since the diver signed a release prior to the dive.
  • Represented the wife of a diver who suffered a pulmonary embolism during an introductory scuba course taken while on his honeymoon in Hawaii in a case brought against P.A.D.I and diver operatores. His death was witnessed by his new bride.  The case settled and the amount is subject to a nondisclosure agreement.
  • Represented the wife of a diver who died while using a rebreathing device while using it in a Maryland quarry. Case was tried against the manufacturer in New Hampshire Federal Court. Defense verdict after a two week trial.

Sexual Assault and Battery

  • 3.2 Million dollar jury verdict. Plaintiff was an employee of a massage parlor and was raped while on Defendant’s premises. Jury verdict for $2,000,000.00 (with 1.2 Million added for interest) for plaintiff.
  • Represented a minor who was raped while being treated at an in-patient facility.  The case settled.
  • Represented a minor female who was admitted to the defendants bar despite being underage.  She met four boys (3 of whom were also minors) who offered her a ride back to Harvard University where she was a student.  Instead, they took her to a remote area where they gang raped her.  The case settled.

Product Liability Cases

  • The plaintiff was seriously injured when a ceiling collapsed.  Represented the manufacturer of the plugs that were shot into the cement roof that anchored the ceiling.   I settled the case prior to trial.  The case continued against other defendants. The Plaintiff won over 2.2 million dollars in the final verdict.
  • Three children were burned over 90 percent of their bodies when a fire broke out in the garage of their home.  My client was released from the claim without contribution to settlement.
  • The Plaintiff alleged that a forklift truck that he was operating was improperly serviced and otherwise defective.  The forklift slid into a rack causing the collapse of the rack’s contents onto the Plaintiff causing severe injuries.  Represented the Defendant Lewis/Boyle against Product Liability and Negligence claims.  There was a Jury Verdict in favor of my client after a four-day trial
  • The plaintiff was injured while driving a golf cart.  Represented the manufacturer of the golf cart.  The case settled without trial.
  • Represented the Defendant manufacturer of a prosthetic device in a case brought against it for the failure of that device.  The case settled.
  • Represented the Defendant manufacturer of a prosthetic device in a case brought against it for the failure of that device.  The case settled.
  • Federal Court case regarding allegedly improper roofing materials substantially depreciating the roof of a large commercial building. The case settled.
  • The plaintiff was the wife of a man who was killed when he entered a high-capacity icemaker on the Boston Harbor Docks.  Represented the Defendant manufacturer.  The case settled.
  • Represented the Defendant manufacturer of a switch assembly that was part of a crane.  The plaintiff was severely injured when the crane made an uncommanded operation.  The case settled.
  • Represented a defendant in a product liability action.  The case was settled.
  • Represented the Defendant manufacturer of an orthopedic brace that allegedly failed.  The case settled.
  • The Plaintiff alleged that she drank tainted milk and suffered panic attacks shortly after ingestion. Represented the Defendant West Lynn Creamery against Product Liability, Negligence and 93(A) claims brought against it.  There was a Verdict in favor of my client after a seven-day jury trial.
  • Represented the Defendant manufacturer in a claim for the negligent design and maintenance of their golf cart.  The case settled.
  • The Plaintiff alleged that a defect in the manufacture and/or assembly of a file cabinet system caused it to fall on top of her.  Represented the Defendant Supreme Equipment & Systems Corp. against Product Liability and Negligence claims brought against it. There was a Verdict in favor of my client after a three-day jury trial
  • Represented the Defendant manufacturer and distributor. The case settled.
  • The plaintiff lost his hand while working on a punch press.  Represented the defendant. The case settled.
  • The Plaintiff alleged that forklift truck that he was operating was improperly serviced and otherwise defective.   Represented the Defendant Lewis/Boyle against Product Liability and Negligence claims.  The case settled after three-day jury trial
  • Represented the Plaintiff, who suffered a heart attack induced by carbon monoxide poisoning from gas that originated from a poorly maintained gas fired furnace.  Suit was brought against both the condominium association and the manufacturer of the gas-fired furnace.  Verdict was for my client against the condominium association after a five-day jury trial

Negligence Actions

  • The Plaintiff was injured while working on a construction site.  Represented the Defendant, Gunning Metals, against Construction Accident Liability and Negligence claims brought against it.  Defense verdict after a two-day trial.
  • Represented the Plaintiff, an ironworker, who was injured when a railroad bridge opened while he was working on it.  There was a Verdict for my client against the railroad after a four-day jury trial.
  • Represented the Plaintiff who suffered a heart attack induced by carbon monoxide poisoning from gas that originated from a poorly maintained gas-fired furnace.  Suit was brought against both the condominium association and the manufacturer of the gas-fired furnace. There was a Verdict for my client against the condominium association after a five-day jury trial.
  • The Plaintiff alleged that a forklift truck he was operating was improperly serviced and otherwise defective.  The forklift slid into a rack causing the collapse of the rack’s contents onto the Plaintiff. Represented the Defendant Lewis/Boyle against Product Liability and Negligence claims.  There was a Verdict in favor of my client after a four-day jury trial
  • The Plaintiff alleged that a defect in the manufacture and/or assembly of a file cabinet system caused it to fall on top of her.  Represented the Defendant, Supreme Equipment & Systems Corp., against Product Liability and Negligence claims. There was a Verdict in favor of my client after a three-day jury trial.
  • The Plaintiff alleged she drank tainted milk and suffered panic attacks shortly after ingestion.  Represented the Defendant West Lynn Creamery against Product Liability, Negligence and 93(A) claims.  There was a Verdict in favor of my client after a seven-day jury trial.
  • Represented the Plaintiff, a Boston Police Officer.  While on patrol his police cruiser struck a protruding manhole cover in a construction site.  Mr. Cametti was partially paralyzed as a result.  The case settled after extensive trial preparation.
  • Represented the Plaintiff, who suffered from the effects of long term carbon monoxide poisoning from gas that originated from a poorly maintained gas-fired furnace located in his bedroom.  Suit was brought against the landlord. The case settled without trial.
  • Represented the Defendant driver in a motor vehicle accident case.  There was a Verdict in favor of my client after a two-day jury trial.
  • The Plaintiff alleged that a forklift truck he was operating was improperly serviced and otherwise defective.   Represented the Defendant Lewis/Boyle against Product Liability and Negligence claims.  The case settled after three-day jury trial
  • Represented the plaintiff, who was struck by a drunk driver who had been drinking in the defendant’s bar.  The case settled.
  • Represented the defendant in an action brought against it by the plaintiff.  The case settled without trial.
  • Paul H. Gross v. Epoxy Technology, Inc., et al.,  (Middlesex Superior Court).  Represented the Defendant in a negligence case.  The case settled.
  • Represented the defendant in an action brought against it by the plaintiff. The case settled without trial.
  • Federal District Court action – District of Massachusetts. Represented the Defendant Needle Industries. The case settled.
  • Represented the Defendant RBW Enterprises, Inc. in a claim brought against it. The case settled.
  • Represented the Defendant Gunning Metals in a claim brought against it by the plaintiff. The case was settled.
